1. Introduction
These Terms and Conditions govern the complimentary moving service (“the Offer”) provided by Wingfield Property (Pty) Ltd (“Wingfield Property”, “we”, “our” or “us”). By accepting or making use of the Offer, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
The Offer is intended to provide qualifying sellers with a contribution towards the cost of relocating from their property following a successful sale through Wingfield Property. The Offer is promotional in nature and is subject to these Terms and Conditions.
2. Eligibility
The Offer is available exclusively to qualifying residential property sellers who have concluded a successful sale through Wingfield Property.
To qualify, the seller must:
- have entered into a valid mandate with Wingfield Property;
- have sold the property through Wingfield Property;
- be the owner of the property being sold;
- have an Agreement of Sale that has become unconditional, meaning that all suspensive conditions (if any) have been fulfilled or waived in accordance with the Agreement of Sale; and
- complete the move within 60 (sixty) days of the date of registration of transfer, unless otherwise agreed by Wingfield Property in writing.
The Offer is not available to:
- purchasers or buyers;
- tenants;
- landlords or lessors;
- estate beneficiaries;
- developers;
- commercial or industrial property transactions;
- rental transactions; or
- any person who did not sell their property through Wingfield Property.
Wingfield Property reserves the right to verify eligibility before approving the Offer.
3. Nature of the Offer
Wingfield Property will contribute up to a maximum value of R7,000.00 (Seven Thousand Rand) towards the cost of one residential move.
Where the total cost of the move exceeds R7,000.00, the seller shall be solely responsible for payment of the balance directly to the moving company before or on the date required by the moving company.
The Offer constitutes a contribution only and does not cover the full cost of every move.
The Offer is limited to one move per successfully sold property, irrespective of the number of registered owners or sellers.
4. Moving Service Provider
The moving services are provided exclusively by Wingfield Property’s nominated moving partner.
Wingfield Property reserves the right to appoint, replace or change the nominated moving company at its sole discretion.
The seller may not substitute the nominated moving company with another service provider. Should the seller elect to use an alternative moving company, the Offer shall immediately lapse and no reimbursement or contribution shall be payable.
Wingfield Property shall pay its contribution directly to the nominated moving company. Under no circumstances will Wingfield Property make payment to the seller.
5. Included Services
The services included under the Offer will depend on the quotation prepared by the nominated moving company and may include, where applicable:
- professional furniture removal;
- loading and unloading;
- packing and unpacking services;
- protective wrapping of furniture and fragile items;
- protective mattress and couch covers;
- packing materials;shuttle vehicles where required;
- hoisting services;
- weekend moves, subject to availability; and
- other standard residential moving services offered by the nominated moving company.
Additional services requested by the seller that fall outside the approved quotation may be charged separately and shall be for the seller’s own account.
6. Booking and Availability
The Offer is subject to the availability and operational capacity of the nominated moving company.
Although every reasonable effort will be made to accommodate the seller’s preferred moving date, neither Wingfield Property nor the nominated moving company guarantees availability on any specific date.
The seller is responsible for arranging the move with sufficient notice.
Changes to confirmed bookings may result in additional costs, which shall be payable by the seller.
7. Insurance
Wingfield Property is not an insurer and does not provide insurance cover in respect of household contents.
The nominated moving company includes limited Goods-in-Transit cover in accordance with its own Terms and Conditions. Sellers who require broader protection are strongly encouraged to obtain optional All Risk Transit Protection or equivalent insurance covering the full replacement value of their household contents before the move. Optional transit protection is available directly through the moving company at the seller’s election and expense.
It remains the seller’s responsibility to ensure that adequate insurance is in place.
8. Liability
Wingfield Property acts solely as the sponsor of the Offer and is not the provider of the moving services.
Accordingly, Wingfield Property accepts no responsibility or liability whatsoever for:
- loss of or damage to household contents;
- breakages;
- scratches;
- theft;
- delays;
- failed deliveries;
- damage to property;
- injury to persons;
- acts or omissions of the moving company;
- negligence of the moving company or its employees;
- consequential or indirect damages; or
- any dispute arising from the moving services.
The moving contract exists solely between the seller and the nominated moving company.
9. Claims
Any claim relating to:
- damaged goods;
- missing items;
- delays;
- insurance;
- property damage; or
- the quality of the moving service,
must be submitted directly to the nominated moving company in accordance with its Terms and Conditions and applicable claims procedures.
Wingfield Property shall not investigate, adjudicate or settle any such claims.
10. Exclusions
The Offer does not include, unless specifically agreed in writing:
- storage;
- vehicle transportation;
- pet transportation;
- specialised crating;
- customs duties;
- international relocation costs;
- insurance premiums;
- cleaning services;
- disposal services;
- packing materials beyond those included in the quotation;
- any charges exceeding the R7,000 contribution; or
- any services not reflected on the approved quotation.
The seller shall remain liable for any additional costs incurred.
11. No Cash Alternative
The Offer:
- has no cash value;
- may not be exchanged for cash;
- may not be transferred;
- may not be sold;
- may not be redeemed against commission;
- may not be used with another moving company; and
- may not be substituted for any other product or service.
If the seller elects not to use the Offer, it shall automatically lapse without compensation.
12. Cancellation
If the seller cancels or postpones the move after confirmation, any cancellation, postponement or administration fees charged by the nominated moving company shall be for the seller’s account where such charges are not recoverable by Wingfield Property.
Should the Agreement of Sale be cancelled, lapse, fail to become unconditional, or should transfer not proceed for any reason whatsoever, Wingfield Property reserves the right to withdraw the Offer with immediate effect. Where Wingfield Property has already incurred costs in relation to the Offer prior to such cancellation, Wingfield Property reserves the right to recover those costs from the seller where legally entitled to do so.
13. Promotional Nature
The Offer is provided solely as a promotional benefit by Wingfield Property.
Wingfield Property reserves the right to amend, suspend or discontinue the Offer at any time for future transactions.
Any amendment shall not affect a qualifying Offer already confirmed in writing unless required by law or circumstances beyond Wingfield Property’s reasonable control.
14. Third-Party Services
The moving company operates independently from Wingfield Property.
Wingfield Property makes no warranties, guarantees or representations regarding the services provided by the moving company and shall not be responsible for the performance, conduct or obligations of the moving company.
Acceptance of the Offer constitutes acceptance that the seller enters into a separate contractual relationship with the nominated moving company and will be bound by that company’s Terms and Conditions, including its policies relating to insurance, liability, claims and service delivery.
15. Force Majeure
Wingfield Property shall not be liable where the Offer cannot be fulfilled due to events beyond its reasonable control, including but not limited to severe weather, natural disasters, strikes, civil unrest, accidents, vehicle breakdowns, supplier failure, government restrictions or any other force majeure event.
16. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
Any dispute arising from these Terms and Conditions shall be subject to the jurisdiction of the courts of South Africa.
17. Acceptance
By making use of the complimentary moving Offer, the seller confirms that they have read, understood and accepted these Terms and Conditions, together with the applicable Terms and Conditions of the nominated moving company.
